The government has decided to waive off the penalty for late filing of GST returns (GSTR-3B)for the months of August & September. This will be a significant relief to small and medium enterprises (SMEs). Even the taxpayers who have paid the penalty; will be credited back. The Union government waived off the penalty on the delayed filing of initial GST returns on Tuesday.
No Penalty for Late Filing GSTR-3B
Filing GSTR-3B is mandatory even if the assessee has no transactions during a month. He still has to file a nil return. Even the interest at 18% per annum is payable on the amount of outstan
ding tax to be paid. Late fee for filing GSTR-3B subsequent the due date is as follows:
- Rs. 20 per day of delay for taxpayers having nil tax liability for the month.
- Rs. 20 per day of delay.
Many businesses were not able to file returns due to various reasons. Due to this, the late fee surpassed the overall company’s tax liability, as per the report in money control. Ear
lier the government had waived off the late fee for the delayed filing of the maiden returns for July. So many businesses and firms demanded the waiver of penalty for delayed filing off GSTR-3B.
However, as per the 23rd GST council meeting, this late fee has been waived off, and any late fee which the taxpayer has paid will be credited back to his account.
Abhishek Jain, tax partner, EY India told that the waiver of the late fee on the delayed filing of GSTR-3B is a welcome step from the finance minister. GST is a new law & the taxpayers are still getting used to it coupled with GSTN related issues, this waiver was clearly warranted.
